Chapter 7 vs. Chapter 13
To obtain debt relief through a Chapter 7 bankruptcy, you must meet certain eligibility requirements, including what is known as the “means test.” In order to pass the Chapter 7 means test, your income over the past six months must be lower than the median state income. For those people who do not meet the eligibility requirements of Chapter 7, a Chapter 13 bankruptcy may be an option.
A Chapter 7 bankruptcy, sometimes called a debt liquidation bankruptcy, eliminates or discharges all unsecured debts, including credit card debts and medical bills. A Chapter 13 bankruptcy, sometimes called a debt reorganization bankruptcy, allows people to pay back a portion of their unsecured debts as well as their secured debts over a three to five year period. Secured debts are typically debts on houses or automobiles. In addition, a Chapter 13 bankruptcy may reduce the amount and interest of certain debts.
